If I am not mistaken, David Fravor said no one came and got the tapes... I think he states that he heard that might happen and he and went collected them and was initially blocked, but since he out ranked the person holding them, he gave him what for and took his tapes, made copies... And so, we introduce another element- things happened, didn't happen.
